I (we), the undersigned, acknowledge that being on a ranch involves uncertain and heightened amounts of risk of injury or death, whether it arises from riding a horse or being in a moving vehicle, or from an encounter with wildlife of any type, or from walking, hiking, fishing, camping, hunting and the discharge of fire-arms and other hunting activities or from exposure to the natural elements including rain, sleet, wind, lightening, hail, ice, snow, land movement, rivers, ponds, streams, or vegetation, or from the consumption of foods and beverages, or from encounters with other humans.
I (we) expressly assume, for myself and any minor children accompanying me, all such risks and waive any claim against the Moon Ranch (which includes any owner or employee or other guest or their property), except to the extent that such claim is based upon the sole and exclusive negligence of the Moon Ranch. I further agree to hold the Moon Ranch harmless for any form of injury or property damage which results in any way from the presence of this guest on the Moon Ranch, including violation of any Moon Ranch rules and instruction or the terms and conditions of this Release.
I (we) acknowledge reading and understanding this Release. This Release shall be binding on me and any minor(s) accompanying me and shall be in effect for the duration of the stay at the Moon Ranch, including any repeat visits.
The Moon Ranch Corporation (Moon Ranch) reserves the right to use any and all print or digital media taken at Moon Ranch, without the expressed written permission of those having taken or whom are included within the media.
Moon Ranch may use the digital or print media material produced, used or contracted at Moon Ranch in mediums including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc. To ensure the privacy of all guests and employees, images will not be identified using full names or personal identifying information without approval from the photographed subject or legal guardian. By participating in a Moon Ranch event or by failing to notify Moon Ranch, in writing, of your desire to not have your photograph used by Moon Ranch, you are agreeing to release, defend, hold harmless and indemnify Moon Ranch from any and all claims involving the use of your picture or likeness. Any person or organization not affiliated with Moon Ranch may not take, use, copy, alter or modify Moon Ranch print or digital media including photographs, graphics, videography or other, similar reproductions or recordings without the advance written permission of Moon Ranch.
